St Julian's is now an extension of Sliema although it started life as a small fishing port based on Spinola and Balluta Bays. The Lessee undertakes to allow the Lessor or his/her Agent to inspect the premises whenever the Lessor deems it necessary. For this purpose, the Lessor reserves for himself or his Agent or representative the right of access to the premises provided such inspection is carried out at a reasonable time and provided reasonable advance notice thereof shall have been given to Lessee.
The Lessee is liable for any damages sustained by him/her, this only applies through negligence.
The Lessee undertakes to leave the flat clean or the payment of a minimum charge of €50.00 to cover the services for cleaning.
Smoking inside is not permitted. A fine of € 250.00 will be charged.
No musical instrument / loud TV shall be played in upon any part of the property between the hours of eleven (11:00) p.m. and seven (7:00) a.m. nor shall any singing or dancing be permitted between the said hours and the Lessee shall use his best endeavours to prevent the occurrence of any undue noise.
The Lessee shall in no way encumber or interfere with the access to the common parts of the block by leaving rubbish, cycles, vehicles or things or any goods or packages belonging to him, his servants, agents or guests.
Rubbish containers are found in the Garbage room at level -5 where parking garage area is.
Article One: Use of the Apartment
The Lessee shall use the Apartment for residential purposes only.
Article Two: Maintenance of the Apartment
(a)The Lessee shall in all respects keep, maintain and take all reasonable care of the Apartment, appurtenances, fittings, furnishings, effects and other contents thereof, and at the end of the Lease, will deliver them up to the Lessor in as good a state and condition as at the Commencement Date, always excepting fair wear and tear. For this purpose, an inventory of the furnishings and other contents and a description of the condition thereof on the Commencement Date, is being attached to this Agreement and marked Annex A (hereinafter called the “Inventory") and is being signed by the Parties who are hereby confirming the veracity of its contents and details.
(b)If Lessee refuses or neglects to discharge its obligations pursuant to this Article to the reasonable satisfaction of Lessor, the Lessor shall inform the Lessee accordingly by notice in writing stating the default and the time within which it should be remedied. If the default is not remedied within the time stipulated in the notice, the Lessor may make such repairs or undertake such maintenance itself. Upon completion of such work, the Lessee shall promptly reimburse Lessor for all costs incurred by it in making such repairs or maintenance. Lessor's rights under this Article shall be without prejudice to any other right or remedy competent to it.
(c)The Lessor shall be responsible for all extraordinary repairs and maintenance throughout the term of the Lease.
(d)The clearing of sinks and drains, and damage to bulbs, light fittings, water geyser/s, fridge and cooker, microwave, hob as well as any minor defects in the water and electricity installation are to be addressed by the Lessor.
(e)The Lessee is not allowed to carry out any maintenance work and other reversible acts such as attaching appliances, hanging picture frames, television installation, telephone installation, etc. Attachments or installations which are irreversible will only be made by the Lessee with express prior consent in writing from the Lessor.
(f)The Lessee binds himself not to allow animals or other pets to be retained in the Apartment for any period of time.
(g)No washing, clothes, carpets, rugs, etc are to be hung in the terrace/s, balcony/s, or otherwise exposed to public view.
The Lessee undertakes to maintain the Apartment clean and tidy throughout the period of the Lease and on its termination.
Article Three: Assignment, Sub-Letting or Transfer
(a)The Lessee is not entitled to sublet any part of the Apartment, nor take in paying guests, without the prior written consent of the Lessor. Provided however that the Lessor hereby authorises the Lessee, on an a priori basis, to allow the Lessee's staff to reside within the Apartment.
(b)The Lessee shall not assign or transfer the Lease in any manner whatsoever, and any assignment or other transfer made in breach of this Agreement shall be null and void and shall entitle the Lessor to terminate this Agreement forthwith.
(c)The Lessor may transfer the Apartment at any time subject to ensuring that the new owner accepts to respect the terms of this Agreement.
(d)The Apartment is for the sole use of the Lessee.
