Deluxe 4 bedroom 1,972 sq ft penthouse unit of 2 unit duplex,across from wide sandy beach, wooden walkway to the beach, LIFE-GUARDED in season. LINENS INCLUDED FOR WEEK STAYS.A new King Sleep Number bed, a King & 2 more Queens. Ocean & canal views, PRIVATE ELEVATOR, outside shower, covered parking. Close to restaurants, fishing, kayak launch. All the comforts you are used to comfortable furniture inside & on the porch, wireless internet, TVs in all but 1 room, HBO etc. 2 DVRS & surround sound. .

The space

This is a 1,972 sq. ft. deluxe penthouse top unit of a only two unit duplex serviced by a private elevator or steps. LINENS INCLUDED FOR WEEK STAYS. It is directly across the street from the ocean and a wooden walkway to the beach which is life guarded in season; the street is easy to cross as it normally does not have much traffic and has a 25 mph speed limit. There are views of the ocean and some canal views. All rooms are on one level with an open floor plan providing a living room, dining room with a table that seats 8, full kitchen,and a breakfast nook with a table and bar seating. Ocean views from the living room, sitting room and front porch with swivel rocking chairs in the living room allowing you to enjoy the ocean view. Hardwood floors are in the main living area, carpet in bedrooms and ceramic tile in the full baths and kitchen. There are ceiling fans in all bedrooms, kitchen and living room. The kitchen has granite counter tops with stainless steel appliances, equipped for the cook with a large number of kitchen items & an assortment of spices. There is a wall oven, glass cook-top, microwave, toaster oven, coffeepot, side-by-side refrigerator with ice maker and filtered water, blender, and a garbage disposal. TVs are served by Charter Cable with PREMIUM SERVICES of HBO, Cinemax, & Showtime, etc. in kitchen, living room, and all bedrooms but the Sitting Room. THERE ARE TWO DVRS ALLOWING YOU TO RECORD, PAUSE AND REWIND SHOWS: ONE IS ON THE 55" LIVING ROOM TV WITH SURROUND SOUND AND THE OTHER IS A TIVO IN THE MASTER BEDROOM. Secure wireless internet is provided.
The Master Bedroom has a new King Sleep Number bed, a large master bath with jetted garden tub, double sinks in a large vanity, separate shower and toilet room, and a large walk-in closet. The sitting room off the Master Bedroom is the 4th bedroom with a Queen bed. It is only accessed through the Master Bedroom or from the front porch; French doors, with shades for privacy, separate it from the Master Bedroom. This room has a small chest of drawers, a writing desk, but no closet, but the Master closet is very large.
The two other bedrooms share a Jack & Jill bath with a double vanity and a tub/shower combination and toilet in a separate room. Both back bedroom open to the back balcony porch furnished with two rocking chairs for you to enjoy the morning summer breezes. One bedroom has a King bed and the other a Queen. For stays of a week linens are included, consisting of bed linens, and bath towel sets. Both bathrooms have soap, shampoo & conditioner wall dispensers. Fixed charcoal grill in backyard.
There is laundry room with an HE washer and a dryer. The front porch has a dining table with 4 chairs and a very comfortable lounger, beverage side table, and a chair with ottoman. Under the building is a large enclosed shower with hot and cold water and a covered parking area for 3 cars. A Kayak Launch and Dinghy Dock is located on the canal behind the house. You are not charged by the person, but a nightly rate for the entire condo that sleeps up to 8.
When comparing places, please remember we offer two King beds, one a Sleep Number bed, and two Queens, wireless cable internet throughout the whole house, soap, shampoo, & conditioner dispensers, water filtering shower in Master Bath, filtered refrigerator water, two DVRs, upscale furniture, an elevator, HE Washer & Dryer, private outdoor shower with hot & cold water, covered private parking, and right across from the beach. Also all rooms are on one level with no steps within the unit. When there is a 4 day minimum a 10% discount will be given for stays of a week. 7 day stays are required in Prime Season.

Guest access

You will have use of the entire unit except for some locked owner closets. You will have a private front porch and back porch, a shared private outdoor shower with hot & cold water, shared charcoal grill, and PARKING FOR 3 CARS under the unit. Please do not park on the lawn nor on the street as the police will tow your vehicle.

Interaction with guests

I live in Wilmington and will happy to answer any questions and address any problems quickly. There will be a Welcome Book for you to use with information about the unit and the area.
I will only give the keys to the person renting the unit, and not to another family member, nor friend, so be sure to arrive before your guests so they will have access to the house.

Other things to note

1) Linens are included for stays of a week. If staying for less than a week, Linens including bedding and bath towel sets can be added for $110 or less if you do not use all beds.
2) You will need to bring your own beach towels and beach chairs. I can provide you with a reliable place to rent beach equipment.
3) NO PETS AND NO SMOKING POLICY IS STRICTLY ENFORCED! You may not smoke inside or on the decks or balconies. If any evidence/sign of smoking is found inside or on the deck/balcony , there will be a $250 charge for clean up and air restoration charge. It will also result in immediate eviction. If a pet is found in or on the property, there will be a non-refundable extermination fee of $250, plus tax as well as mandatory immediate removal of the pet. In addition, guests/renters will be asked to vacate the premises for breach of rental/lease contract.
4) THIS IS A VACATION RENTAL AGREEMENT UNDER THE NORTH CAROLINA VACATION RENTAL ACT. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS. YOUR SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL.
5) Rental Reservations: During the summer season (May - September) this unit rents as weekly rentals. Partial week summer rentals may be available during the summer based on availability with reservations made 14 days prior to check in. Partial week rentals are allowed during the off season (October thru May).
6) OCCUPANCY
We rent to families, mature adults, and only to persons over the age of 25 years. Guest agrees that no more than 8 persons, except for infants, shall be permitted to stay on the Property during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon Guest under this Agreement. We do not rent for proms, graduations, college house parties, weddings, etc. Misrepresentation will result in
immediate eviction.
7) MANDATORY EVACUATION
Since this property is located along the coast, if in the unlikely event that State or Local authorities order a mandatory evacuation of the area that includes the premises, the Tenant shall comply with the order. We suggest that you purchase Travel Protection insurance that covers hurricane evacuations to secure your vacation investment and eliminate financial risk.
8) CONDITION AND USE OF PROPERTY
The Property is provided in "as is" condition. Rental Agent shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, satellite or cable TV access or hot tubs as applicable. Rental Agent shall not be held responsible for such items failure to work, nor make rental adjustments, but will make every effort to correct any issues as reported as quickly as possible. Guest acknowledges that use of amenities such as elevator, hot tubs, pools, spas, grills, decks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the
Guest's own risk. Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.
I will only give the keys to the person renting the unit, and not to another family member, nor friend, so be sure to arrive before your guests so they will have access to the house. You will have two - three sets of keys; lost of keys will be charged at $25/set.
9) DEFAULT
lf Guest should fail to comply with the conditions and obligations of this
Agreement, Guest shall surrender the Property, remove all Guest's property and belongings and leave the Property in good order and free of damage. lf owner or representative has to be called out to the property due to excessive noise, property damage, unruly conduct, or over the limit occupancy, the owner has the right to terminate the rental agreement. Tenant may be evicted if he holds over in possession after Tenant's tenancy has expired, commits a material breach of any provision of this
agreement, fails to pay rent as required, or has obtained possession of the Premises by fraud, or misrepresentation. No refund of any portion of the Total Rental Fee shall be made, and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.
10) ASSIGNMENT OR SUBLEASE
Guest shall not assign or sublease the Property, nor permit the use of any portion of the Property by other persons who are not family members or guests of the Guest and included within the number of and as permitted occupants under this Agreement.
11) RISK OF LOSS AND INDEMNIFICATION
Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Rental Agent shall not be responsible or liable for any reason whatsoever.
Guest hereby covenants and agrees to indemnify and hold harmless Rental
Agent and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legablfees and other actions for any damages, costs, attorneys fees incurred by Guest, permitted guests, visitors or agents, representatives or successors of Guest due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property and Guest
expressly agrees to save and hold Rental Agent harmless in all such cases.
12) ENTRY AND INSPECTION
Rental Agent reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or showing the Property to prospective purchasers, renters or other authorized persons. lf Rental Agent has a reasonable belief that there is imminent danger to any person or property, Rental Agent may enter the Property without advance notice.
13) UNAVAILABILITY OF PROPERTY
ln the event the Property is not available for use during the Rental Term due to reasons, events, or circumstances beyond the control! of Rental Agent, Rental Agent shall return all payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Rental Agent shall have no further obligations or liabilities in any manner pertaining to this Agreement.

This Rental Agreement and Contract (the “Agreement”) is a legally binding
Agreement made and entered into as of the Reservation Date made by renter
and between the undersigned person(s) or company (the “Guest”) who is of 25 years of age or older and the undersigned owner (“Rental Agent”), pursuant to which the Guest has agreed to rent the residence described below (the “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.

OCCUPANCY
We rent to families, mature adults, and only to persons over the age of 25 years. All occupants must be 25 years or older unless accompanied by their parents. Guest agrees that no more than 7 persons shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon Guest under this Agreement. We do not rent to proms, graduations, college house parties, weddings, etc. Misrepresentation will result in immediate eviction.

SECURITY DEPOSIT
Any security deposit provided may be applied to actual damages or unauthorized charges caused by the tenant or their guests. Owner shall apply, account for, or refund Tenant’s security deposit within 14 days following the end of tenancy.
Smoking is not allowed; if detected a $200 fee will be deducted from the security deposit. Loss of keys will result in a $25/ set deduction from security deposit. Pets are not allowed. Detection of a pet will result in expedited eviction and a $250 extermination fee from the security deposit. If guests unhook our cables to hook up their components, they must reattach everything like it was so the TV, DVD player and receiver work as they did on check-in. Failure to do this will result in a minimum $150 AV trip charge, and charges could be more if one or more of the components is damaged.
A deduction will be made for dirty dishes, dishes left in dishwasher, or trash left in the unit. If items are left behind, we will attempt to locate them and mail them back to you; you will be charged $25 plus postage.

RELEASE
Guest hereby waives and releases any claims against Rental Agent, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guest on or near or adjacent to the Property, including any common facilities, activities or amenities.
Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility.

ENTRY AND INSPECTION
Rental Agent reserves the right to enter the Property at reasonable times and
with reasonable advance notice for the purposes of inspecting the Property or showing the Property to prospective purchasers, renters or other authorized persons. If Rental Agent has a reasonable belief that there is imminent danger to any person or property, Rental Agent may enter the Property without advance notice.

UNAVAILABILITY OF PROPERTY
In the event the Property is not available for use during the Rental Term due to reasons, events, or circumstances beyond the control of Rental Agent, Rental Agent shall return all payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Rental Agent shall have no further obligations or liabilities in any manner pertaining to this Agreement.

ADDITIONAL TERMS TO THE RENTAL AGREEMENT
In addition to the standard terms included herein, Guest acknowledges and agrees that the following additional terms and conditions apply to the Guest’s rental of the Property:

GENERAL PROVISIONS
This Agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both the Guest and the Rental Agent. This Agreement shall be governed by the Vacation Rental Act. The words “Rental Agent” and “Guest” shall include their respective heirs, successors, representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein. This Agreement may be signed in one or more counterparts, each of which is an original, but taken
together constitute one in the same instrument. Execution of a digital signature shall be deemed a valid signature.

Beautiful home with lovely beach decor and very comfortable accommodations for 8 adults. Easy access to a quieter beach area but within a beach stroll of the Carolina Beach boardwalk. Host is warm and welcoming and accessible if needed.

This penthouse is beautifully decorated with an open floor plan. Right across from a nice uncrowded beach. The home is on a quiet street. There was enough room from our family of 7. The front deck has a nice ocean view and is a great place to relax together. The kitchen was fully stocked with everything a chef could ever need. The people in Carolina Beach were friendly We had a great time.
