Imagine your own little private, gated sanctuary, on the water … a stunningly lush paradise that is all yours. The warm, scented breeze … flowers … palm trees … exotic flora and fauna. It feels like you’re far from civilization as you relax at pool’s edge and gaze out over the Pacific just a few feet away, or the magnificent mountain backdrop. But, in reality, you’re only a few blocks away from the enticements of bustling Lahaina town; an historic whaling center chock full of great restaurants, shopping, and galleries. Puamana Nani is a 2 bedroom / 2.5 bath condominium. We’re telling you now to give savvy vacationers a heads up, (you will not regret it). And, until the construction is done on the new bypass complete in 2018, there’s highway noise from the backside of the development. We just keep the back windows and doors shut to block most of it out. Brand new AC keeps Puamana Nani cool and quiet! For outdoor enjoyment there's comfortable seating on the front lanai that has a slice of ocean view.
Guests have free reign of the expansive Puamana Community complex's beautifully landscaped grounds, with its delightful fountain, pond, gazebo, and patio. The lavish amenities are completed by 3 pools, immaculate tennis courts, laundry facilities, a community grill, an exercise room, and friendly communal areas sprinkled throughout – perfect to relax or congregate. It’s quite easy to reserve the Puamana Clubhouse for family and friends. It’s the perfect spot to BBQ and enjoy drinks while watching the sun slowly disappear behind the crashing waves (sunsets are a daily occurrence!).

Chris and I are a small “mom and pop” operation (literally). We take great pride in the personal service we provide for visitors from around the world. You’ll find that we take your vacation seriously, and offer as much hands-on attention to your visit as you can handle. We’re also heavily invested in our community. We enjoy stimulating the economy, providing jobs, and promoting local businesses in a cooperative way. We raised our kids here and, because of Maui’s extreme beauty and endless supply of outdoor activities, have been able to immerse ourselves in nature while creating great memories together. Pressed up against the ocean on one side, and mountains in the other direction, it's a visual feast that nourishes the spirit. Spaciously spread out landscaped grounds, there are daily water sports out your front door, and amenities offered by Puamana Community. Take your pick among 3 pools, tennis courts, a club house with an ocean view exercise room, a commons area to gather with the family for BBQ's, or a sunset session with your favorite glass of wine. Take a little walk to Lahaina for all it has to offer; festivals, galleries, restaurants, live music day and night, and every variety of shops. Enjoy!

- Check in and Check out time: Check in time is 3:00 P.M. the day of arrival. Check out time is 10:00 A.M. the day of departure. Late check-out, or additional days may be arranged, subject to availability plus payment of additional fees. Quiet Hours: Quiet hours are from 9:00 p.m. to 8:00 a.m., during which time the noise from the short-term rental condo shall not unreasonably disturb adjacent resident neighbors. Sound that is audible beyond the property boundaries during non-quiet hours shall not be more excessive than would be otherwise associated with a residential area. Puamana Surf is located in a residential neighborhood. Please respect our neighbors. US mainland and global visitors often arrive from different time zones so if awakened early be conscious of the time. Be aware that loud conversation and slamming car doors is a disturbance and loud music is never allowed. Amplified sound that is audible beyond the property boundaries of the short-term vacation rental condo is prohibited. The owners live 30 minutes away and will visit promptly upon neighborhood complaints. Guests are advised that noise travels easily, and that it is important to be respectful of others at all times. There is a noise curfew at 9:00 PM in all residential areas and all Guests are expected to comply with this rule. Parking: Vehicles shall be parked in the designated on site parking area and shall not be parked. No parties or group gatherings other than registered guests shall occur. Use - The premises are to be used exclusively for residential purposes. No retail or other commercial use of premises is permitted. The premises are not to be used for meetings, receptions or for parties in excess of 10 people over the number of registered Guests. Overnight accommodations are restricted to the number of Guests agreed upon in advance and stated in this agreement. Any unregistered Guests shall be charged an additional $50.00 per night, per person for non-disclosure of the fact. No Parties or Under Age Drinking will be allowed. Unit Capacity – Puamana Surf condominium is designed to accommodate 4 or less guests. Please notify us ahead of time if the number of people in your party has changed. Deposits/Payments - There is a $10 per day (maximum $100) Administrative Fee required by Puamana Community Association that will be collected at time of booking. There is a 2 car maximum. Parking is complimentary for one car. There is an additional $10 charge for a second vehicle. Rates subject to change. Cancellation Policy - All payments are non-refundable after final payment unless the unit can be rerented. If more than 60 days out, there will be a $300 cancellation fee assessed plus any insurance charges. Guests are encouraged to purchase travel insurance. No refunds are made for un-used nights regardless of cause. Travel insurance - We recommend that you purchase travelers insurance thru (SENSITIVE CONTENTS HIDDEN)/(SENSITIVE CONTENTS HIDDEN). This is an optional fee which is automatically added to your reservation. The travel protection, if purchased, includes insurance coverage for Trip Cancellation, Trip Interruption, Travel Delay, Baggage Delay, Baggage and Personal Effects, Accidental Death & Dismemberment, Emergency Assistance, Medical or Dental Expense, and Rental Car Damage. Please read your document carefully as certain limitations, restrictions and exclusions apply. Damage - The Guest will at the Guest's expense and at all times maintain the premises, furnishings and appliances in clean and good condition and will surrender the same upon termination of this Agreement in as good a condition as when received. The Guest understands that the Guest will be responsible for repair of all damage. Personal Property of Guests - Guests are advised that personal items lost or stolen are not the responsibility of the Owner. Owner assumes no responsibility for ensuring that the residence is locked and secured during the period of occupation by Guests. In addition, Owner shall be held harmless from all claims or causes of actions arising from the rental and occupation of the residence by Guest. Supplies - A start up amenities package provided for our Guests includes; automatic dishwasher and hand soap, a limited supply of toilet paper and paper towels. Any supplies beyond the initial start up amenities package provided by Owner are to be supplied by the Guest. Maid Service - The Units will be clean upon your arrival. Additional maid service at the guest's expense is available upon request. Maintenance - Every effort is made to keep the equipment and appliances in good working order, however, the operation of all appliances cannot be guaranteed. A 24-hour emergency cell number is available to report major appliance, plumbing or air conditioning problems. Authorized employees or repairmen may enter the premises during business hours for purposes connected with repair, care or maintenance of rental unit. We will do our best to have any repairs completed quickly; however, NO DISCOUNTS OR REFUNDS WILL BE GIVEN FOR EQUIPMENT OR APPLIANCE FAILURE. Drugs and Hazardous Materials - No illegal substances are permitted on the properties. Pets - Pets are not permitted. Rates - Rates are subject to change without notice. Smoking - Smoking is not permitted inside the unit or on the lanai or on the grounds of Puamana Communtiy at any time. Tax - Unit is subject to all applicable state taxes. Insurance - Guest's personal property and vehicles are not insured by Owner. Owner is not responsible for any loss or theft either inside or outside the units. Entry and Inspection - - Owner reserves the right to enter the premises pursuant to state law; (1) In case of emergency, without prior notice. (2) to make necessary repairs, alterations, improvements, supply necessary or agreed services, exhibit the premises to prospective or actual purchasers, mortgagees, Guests, workmen, insurance agents, or contractors. Disclosure - Although we hire professional pest control services your experience in the tropics may include pests, such as insects, rodents and friendly geckos, which unfortunately cannot be completely controlled. You may also experience dangerous ocean conditions, security issues and strong sun. There are no lifeguards at the pools or beaches. We ask that you be aware of your surroundings and take appropriate precautions. **Owner is not responsible for lost or stolen items** Termination of Tenancy - Upon termination, the Guest will: (1) completely vacate the premises and any parking or storage areas used by the Guest; (2) take out all trash (3) leave keys in unit (4) leave remote controls in the unit, (5) leave unit in the same condition as received (laundry will be done by management company) (6) Owner reserves the right to immediately terminate the tenancy if the Guest violates any part of this agreement. Additional cleaning charge of $50/hr will be assessed if the unit requires excessive cleaning as determined by management. Entire Agreement - The parties acknowledge that this Agreement expresses their entire understanding and agreement, and that there have been no warranties, representations, covenants or understandings made by either party to the other except such as are expressly set forth in this Agreement. Compliance with Law - Both parties agree to comply with all applicable federal, state, and local laws and regulations in performing their duties. Severability - In the event that any provision of this Agreement is found invalid or unenforceable pursuant to judicial decree or decision, the remainder will remain valid and enforceable according to its terms. ERRORS AND OMISSIONS: Every effort has been made to ensure that the information in this agreement, and features / descriptions listed on the website and marketing materials are accurate. Changes in amenities, bed sizes, general accommodations, owner reservations and rate changes can and do happen. If an error does exist, A Perfect Vacation Rental does apologize, however, such errors do not entitle the guest to any refund of money or change of property or dates. Notices: All notices, demands or consents required or permitted under this Agreement will be in writing and will be delivered in person or by facsimile, mailed or emailed prior to stay. The service of any notice on one Guest will be deemed a service of all occupants with the premises. ACCEPTANCE By signing the Reservation Confirmation provided along with this Rental Contract, I confirm that I have carefully reviewed this contract and agree to and accept its terms and conditions. I accept the above assignment and subject myself to all the promises and covenants therein contained. I fully understand that this assignment binds me to comply with all the terms and provisions of this lease agreement. Flight Information: Please remember to let the owner know when you will arrive on Maui and please be mindful of departure times. Paia Surf check out is at 10am and late evening departures require another day rental in order to leave past 10am. Please let the owner know as soon as possible of any late departures or early arrival times. Premises: The premises which are subject to this agreement are located at 177-3 Pualei Dr, Lahaina, HI 96761 and are owned by Annie and Chris McNeil (“Owner”). If you feel the earth shake do not wait for an alarm to sound, immediately head to higher ground. If you hear the tsunami sirens, which sound like a sustained blast, head to higher ground. If a tsunami is detected, you’ve been instructed to evacuate use the designated evacuation route, which is up Baldwin Ave (left on Hana Hwy, and right at the stoplight) NOTE: the siren system is tested on the first weekday of the month at 11:45 a.m. for about one minute, if the alarm sustains a tsunami alert has been issued. Please refer to (URL HIDDEN) for more information. Maui County Water Dept: The Department of Water Supply advises all customers to conserve water in the event of hurricane or tsunami due to high winds and/or flooding that could disrupt power supply to water sources. Customers should store drinking water now for use during the storm in the event water service is shut off. Water and wastewater systems may be compromised if electricity cannot be supplied to power the pumps and motors in the distribution and transmission systems. In the event of a power outage, the Department of Water Supply may shut off valves and isolate tanks to reduce risk of damage and water loss. If this occurs, water will be restored as soon as it is safe for personnel to go out and open lines and flush if necessary. All irrigation systems and other non-essential uses of water should be shut off until further notice. Unnecessary use of the wastewater system should also be minimized. Customers should listen for County updates and are requested to call the 24-hour service line ((PHONE NUMBER HIDDEN)) only if a water problem occurs. Hazardous Conditions: Puamana Surf is located on the scenic North Shore coastline of Maui, however, coastline properties are subject to hazardous conditions that may not be fully appreciated by those not experienced in that type of environment. These conditions include, but are not limited to the following: tsunamis, floods, high waves, hurricanes, earthquakes, Kona wind storms, heavy rains, tides, dangerous currents, under- tow, submerged rocks, and potentially harmful marine animals such as sharks, seals, jellyfish, urchins and other marine organisms. Guest acknowledges that no life guard service is available, and caution must be exercised at all times. By signing this agreement, Guest accepts total responsibility with respect to any accident or injury involving the ocean. Guest acknowledges that ocean can present an unsafe environment for children or other non- swimmers. Guest must exercise caution and respect for Hawaiian waves, water and reefs. Use of public shoreline and ocean areas is solely up to the discretion of Guest and Guest’ invitees. Please refer to the Maui County evacuation plan in case of disaster at (URL HIDDEN) Restrictions: This is strictly a “NO SMOKING” rental. No smoking is allowed inside the home, on the lanais or on the grounds of Puamana Community Association at any time. No pets are allowed. Absolutely nothing besides toilet paper flushed down toilets-that means NO sanitary napkins, condoms, or diapers are to be flushed or put down the drains. Sand must be rinsed off before entering indoor showers. Keys: There is a charge of $25 per key for keys not returned. Loss/Theft: Guest acknowledges that Puamana Surf will be locked whenever Guest is away and that all windows and doors will be locked at night. The Owner is not responsible for any loss of Guest’s property as a result of theft or other damage no matter what the cause. Mediation/Arbitration: All controversies or claims (except any claim that the Owner may have against Guest for nonpayment of rent or damages to Puamana Surf which Owner specifically reserves the option to proceed to court to collect) arising out of or relating to this Agreement or its breach shall be initially submitted to mediation. Any party to this Agreement desiring to submit an issue to mediation shall notify the other parties of such desire in writing. The parties shall then agree within 21 days of the request to a single mediator who will mediate all issues submitted to the mediator pursuant to this paragraph. If the parties are unable to agree on a mediator within the above time frame, then any party may submit a request to a Judge in Maui County, State of Hawaii, for appointment of a mediator under this paragraph. The cost of the mediation shall be equally divided between the parties. If mediation is unsuccessful, then the parties agree to arbitrate the issues (except any claim that the Owner may have against Guest for nonpayment of rent or damages to Puamana Surf which Owner specifically reserves the option to proceed to court to collect) through binding arbitration in accordance with Hawaii law and judgment on the award rendered may be entered in any court having jurisdiction. Any party desiring to submit an issue to arbitration shall notify the other parties of such desire in writing. The parties shall then agree within twenty-one (21) days of said request to a single arbitrator within the above said time frame, then any party may submit a request to a Judge of Maui County, State of Hawaii, for the appointment of an Arbitrator under this paragraph. As part of any judgment to be awarded by the Arbitrator, in the Arbitrator’s sole discretion, award attorney’s fees and costs to the prevailing party. The cost of the Arbitrator shall be equally divided between the parties unless the Arbitrator has come to a reasonable belief that the position taken by either of the parties was frivolous and whereupon the Arbitrator may assess the Arbitrator’s fees and costs against the party whose positions the Arbitrator deems frivolous. Attorneys’ Fees: In the event any party hereto shall bring suit, commence an arbitration, or hire an attorney to compel performance of or to recover for breach of any covenant, agreement or condition contained in this Agreement, the prevailing party shall be entitled to recover from the other party his/her/ its costs and reasonable attorneys’ fees. Place of Suit: Any action at law, suit in equity, or other judicial proceeding, which may be filed to enforce the arbitration agreement as set forth in this Agreement or which may be instituted to enforce this Agreement or any portion thereof which is not subject to the arbitration requirement, if any, shall only be instituted in the courts of Maui County, State of Hawaii. Indemnity Assumption of Risk: Guest, as a material part of the consideration to Owner for this rental, will and does hereby assume all risk of bodily injury, wrongful death and/or property damage occasioned by an accident or nuisance made or suffered in Puamana Surf or resulting from any failure on the part of Guest to operate Puamana Surf in a safe conditions. Guest hereby waives all claims in respect thereof against Owner and its employees, agents, licensees, contractors and invitees (herein collectively called “Associates”), and Guest hereby agrees to indemnify and save harmless Owner and the Associates from and against any and all claims, loss, cost and liability for bodily injury, wrongful death and/or property damage suffered by any persons (including, without limitation, Guest’s and those persons at Puamana Surf with or without Guest’s permissions) arising out of, caused or occasioned by, or resulting from any accident, fire or nuisance at Puamana Surf, or failure to maintain connection with any such claim or any action or proceeding brought thereon. Guest further agrees to cooperate with Owner in defense of any such claim, including, but not limited to, the providing of affidavits and testimony upon request of Owner. Guest, will and hereby does assume all risk of loss or damage to personal property, by whomsoever, and does hereby agree that Owner will not be responsible for loss or damage to any such property, and waives all claims in respect thereof against Owner and Associates arising from any cause whatsoever. Assignability: This agreement is not assignable by the Guest, nor may the Guest sublease Puamana Surf.
