This rental agreement and contract (“The Agreement”) is a legally binding agreement made and entered into as of the Reservation Date written below between the undersigned person(s) (the guest) and the undersigned owner (rental agent), pursuant to which the Guest has agreed to rent the residence described below (the property), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration described herein. This rental agreement contains all of the Conditions, Terms and General Information which shall regulate during the stay of the guest and his/her invitees at this property located in Fort Lauderdale FL 33308. This Rental Agreement is entered by and between owner (“Landlord”) and the Air B&B Renter (“Tenant/Guest”). Owner and tenant may collectively be referred to as the “Parties”. This agreement creates joint and severable liability in the case of multiple tenants. This agreement may be signed in one or more counterparts, each of which is an original, but taken together constitute one in the same instrument. Execution of a digital signature as well as an accepted “booking” from both parties online shall be deemed a “valid” signature. In consideration of the mutual agreements herein contained, Owner and Tenant hereby agree and covenant to and with each other as follow:

1.) Leased Premises; Term of Lease, etc. Use of Premises. Tenant/Guest shall use the Premises as a vacation residence only, and for no other purpose. The property is provided in an “as is” condition”. Owner will use its best efforts to ensure the operation of all amenities in the property, such as Internet access, cable TV, etc. Owner shall not be held responsible for such items failure to work, but will make every effort to correct/repair any issues reported as quickly as possible. Guest acknowledges that use of amenities such as pools, decks, fireplaces and the like may be potentially dangerous and involve potential risks if improperly used, particularly with children and such use is at the guests own risk. Tenant will comply with all laws, rules, ordinances, statutes and orders regarding the use of the Premises. This will include all the rules and regulations governed by THE BERMUDA RIVIERA association. There are no parties or events permitted at any time. Tenant agrees that no more than six (6) persons (including children) may reside on the premises. If Tenant exceeds the above occupancy limit, Tenant will be subject to forfeiture of the security deposit and be responsible for an additional fee of $1500. The minimum age for renters is 25 years old. Tenants are fully responsible for any actions of the persons that would visit including attorney fees, court fees and repairs.

2.) Security Deposit: Tenant shall deposit with Owner, held by this site, a security deposit as security for the performance of the Tenant’s obligations under this online agreement. Owner may (but shall have no obligation to) use the Deposit or any part thereof to cure any breach or default of Tenant under this Agreement, or to compensate owner for any damage as it incurs as a result of Tenant’s failure to perform any of the Tenant’s obligations hereunder. Owner is not limited to the Security Deposit to recoup damage costs, and Tenant remains liable for any balance. If Tenant breaches any terms or conditions of this Agreement, Tenant shall forfeit the Deposit, as permitted by law. The security deposit will be refunded if the following conditions are met:

a. No damage is done to the property beyond the normal wear and tear. Furniture is not stained or torn and no towels or linens are lost or damaged.
b. All garbage is placed in the appropriate refuse containers and instructions followed for garbage days (from “Welcome Book located inside this property).
c. There is no theft or damage to the property due to the negligence of the tenant/guest and/or properly locking and securing windows and doors, as well as turning off all appliances.
d. Guests check out at the agreed upon date a time.
e. Guests follow check out instructions, as well as other instructions detailed in the “Welcome Book” located on the property including returning all keys in the manner in which tenant/guest obtained access to them.


3.) Default. If Tenant defaults in fulfilling any of the conditions and obligations of this Agreement, Tenant shall be in default of this Rental Agreement. Then, in any one or more of such events, subject to any statute, ordinance or law to the contrary, guest shall surrender the property and owner will retake possession of the property. Guest will remove all guests’ belongings and leave the property in good order and free of damage. If Tenant does not cure a default of which he has been notified, or if the default cannot be completely cured or remedied, Owner may at Owners option; (i) cure such default and add the cost of such cure to Tenant’s financial obligations under this Agreement or (ii) declare Tenant in default and terminate the Rental Agreement. No refund of any portion of the total rental fee will be made if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.


4.) Assignment and Subletting. Tenant expressly covenants that it shall not assign or sublease any interest in this Rental Agreement without prior written consent of the Landlord, which consent shall not be unreasonably withheld.

5.) The Premises: Possession and Surrender. Tenant shall be entitled to possession of the Premises on the first day of the Rental Agreement Term at 3:00 PM, and Tenant shall not be obliged to accept possession of the Premises prior to the first day of The Agreement Term. At the expiration of the Rental Agreement Term, Tenant shall peaceably surrender the Premises to the Owner or Owner’s agent by 10 AM in good condition, as it was at the commencement of The Agreement, subject to ordinary wear and tear.

6.) Pets and Smoking. No pets are permitted on the premises. This includes not only the house but also the yard and driveway. No smoking is permitted on the premises. This includes not only the house but the screened porch as well. Smoking inside the rental home is strictly prohibited and will result in full forfeiture of the security deposit and/or the entire cost to remove odors from the home.

7.) Maintenance and Repair. Tenant will, at Tenant’s sole expense, keep and maintain the premises in good, clean and sanitary condition and repair during the term of this Lease. All existing damages must be reported to Owner or Owners agents on the day of entry. Aside from normal wear and tear, any damages reported by Tenant after the day of entry will be the Tenant’s responsibility.

8.) Inspection of Premises. Owner and Owners’ agents shall have the right at all reasonable times during the term of this Agreement and any renewal thereof to enter the Premises for the purpose of inspecting the premises and all buildings and improvements thereon, and for the purpose of making any repairs, additions, alterations or showing the property to prospective purchasers (if applicable) as may be deemed appropriate by Owner. If Owner has a reasonable belief that there is imminent danger to any person or property, Owner or Owners agent may enter the property without advance notice.

9.) No Other Representations, Construction: Governing Law; Consents. This Rental Agreement shall be governed in all respects by, and construed in accordance, with the laws of the State of Florida.

10.) Miscellaneous.

11.1 Indemnification. To the extent permitted by law, Tenant will indemnify and hold Owner, Owners’ agent(s) and Owner’s property, including the Premises, free and harmless from any and all liability for loss, claims, injury to or death of any person, including Tenant, or for damage to property arising from Tenant’s use and occupation of the Premises, or from the acts or omissions of any person or persons, including Tenant, in or about the Premises with Tenant’s express or implied consent, except Owner’s act or negligence.

11.3 Parking. Tenant shall be entitled to use ONLY the garage, driveway and parking circle in front of the home for the parking of motor vehicle(s). No RV’s or campers are permitted. All motor vehicles parked on the property by Tenant or Tenants guests must be legally registered and tagged. Street parking is not allowed.

11.4 Tenant’s Guests. Tenant shall be responsible for the conduct and behavior of his invitees and will not permit unlawful activities or disruptive behavior to occur upon the Property and for any damage caused to the property or its contents.

11.5 City of For Lauderdale Ordinances: Tenant agrees to be bound by the following sound ordinance. “Any sound shall not be plainly audible for a period of one (1) minute or longer at a distance of twenty-five (25) feet or more when measured from the source property line between the hours of 10:00 p.m. and 7:00 a.m. daily and at a distance of fifty (50) feet or more when measured from the source property line between the house of 7:00 a.m. and 10:00 p.m. daily.” Tenant agrees to abide by all City of Fort Lauderdale Vacation Rental Ordinances. 11:6 Sexual Offenders: Tenant understands that it is unlawful to allow for a sexual offender or sexual predator to occupy this residence.

11:7 Unavailability of Property: In the event the property is not available for use during any or all of the Rental Term due to reasons, events, weather or circumstances beyond the control of the owner. Owner will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the guest. If such replacement property cannot be found and made available, Owner shall immediately return all payments made by Guest, whereupon this Rental Agreement shall be terminated and Guest/Owner shall have no further obligations or liabilities in any manner pertaining to this Lease/Agreement.

11:8 Natural Disasters: With said property being located “on the beach” side of the Intercoastal Waterway (East of the Intercoastal Waterway), from time to time weather conditions may warrant an evacuation, either voluntary or mandatory. Guests agree and must follow all local and state authorities instructions if such an event occurs. In a voluntary Owner agrees to refund any Rental Term nights not used by Guests if such an evacuation occurs.

This Agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes(URL HIDDEN) amendments or modifications hereof shall be void unless the same are in writing and signed by both the Guest and the Owner or Owners agent.

The home is beautiful! Pictures are absolutely accurate. The pool is lovely and the backyard is very private. Screened in porch is amazing, and the kitchen is absolutely perfect. The location is wonderful: maybe 5 minutes walk to the beach (it’s just down the street and across the road) and town is a 2 mom drive and 10-15 min walk. Alan and Tim are such gracious hosts, very responsive and accommodating. I would highly recommend Alan and Tim’s home. You will love it!

Luxury accommodations in an Incredible, luxury ranch home. Newly renovated and fully stocked! High quality furniture and linens. The beach is an easy 5-10 minute walk. Beach chairs, blanket, towels, toys and wagon were appreciated! We loved the pool and huge screened in porch. Tim & Alan attention to detail was simply amazing! They went out of their way to provide baby gear for our little ones! We highly recommend this property for u relaxing getaway!
