This private home is not offered any other time of the year and is only offered as a long-term Festival Rental. House rules will be provided for signature with booking.
SUNDANCE FESTIVAL RETREAT on SUNNYSIDE
We ask guests to sign an agreement stating their understanding of house rules, which include "no pets" and "no smoking." Please sign, scan and email the agreement to host in advance of stay.
1.Length of Stay. Guest shall be permitted to occupy The Retreat beginning January 18, 2018 (check-in date) at 2 p.m. and ending January 25, 2016 (check-out date) at noon (if full festival is booked)
2. Damage Deposit of $3000. The following conditions must be met:
No damage is done to the home or its contents.
Occupants do not exceed 10 adults.
No linens or household items are missing.
Check-out procedures have been followed.
No pets have been on premises.
No smoking has occurred on premises
No international telephone charges or telephone directory assistance charges have been incurred.
3.Rules. Guest understands and agrees to abide by the guidelines set forth in the addendum, Use of Property and House Rules. Guest understands that violations may result in eviction without refund of any rental monies paid. Guest agrees to enforce the rules with Guest invitees.
4.Entry by Proprietor or Proprietor’s agents. Proprietor or Proprietor’s agents may enter the premises immediately in the event of an emergency to perform necessary repairs and/or maintenance or check on house operating systems.
5.Assignment. Guest may not assign his rights under this Agreement.
6.Release and Indemnification. Guest release Proprietors from any liability for damage suffered by Guest, his family members or invitees during the Guest’ use and occupancy of The Retreat. Guest shall hold Proprietors harmless from any claims for damages, injury, or death to Guest, his invitees or family members.
7.Force Majeure. There may be circumstances beyond Proprietors’ control and contemplation that may result in The Retreat not being available for your use or full enjoyment. Examples of these include (but are not limited to) destruction or severe damage to the property or a disruption in utility services. In the event of Force Majeure preventing occupancy by Guest, Proprietors will make a full refund of any monies Guest has paid. In the event of an impairment of full use, we will make an equitable adjustment in the rental charges.
8.Innkeeper’s Rights. This Agreement is being entered into under the Utah Innkeeper’s Rights Act, Utah Code Ann. 29-2-101, et. Seq. and does not confer upon Guest any rights under the Utah Landlord Tenant Act. In addition to The Retreat’s statutory eviction rights under the Utah Innkeeper’s Rights Act, The Retreat has the right to evict Guest for a material breach of agreement. If any legal action has to be brought by Proprietors to enforce the terms of this agreement, the prevailing party shall be entitled to all costs (including reasonable attorney fees) incurred in connection with the legal action.
10.Binding Effect. This agreement is binding on and shall inure to the benefit of the personal representatives, heirs, devisees, legatees, successors, and assigns of Proprietors and Guest.
11.Governing Law and Venue. All questions regarding the validity and interpretation of this agreement shall be governed by and construed and enforced in all respects in accordance with the laws of the State of Utah. Any action to enforce or interpret this Agreement shall be brought only in a court of competent jurisdiction in the State of Utah.
1.The Retreat is located in a quiet neighborhood, and Guest agrees to refrain from doing anything that may disturb the peaceful enjoyment of the neighboring property owners. Prohibited uses included but are not limited to: indoor smoking of tobacco or other products; loud, get-togethers of more than 20 people; unlawful activities; cutting or destruction of trees or vegetation; burning of wood in interior fireplace; and discharge of weapons.
2.The Sundance Festival Retreat on Sunnyside is to be used for residential purposes only.
3.A maximum of ten (10) Guests are permitted to stay overnight. If this number is exceeded or renter falsifies occupancy information at the time of reservation, he/she is subject to eviction and loss of deposit. Guests are not permitted to use living room or media room sofas as beds.
4. No pets are allowed.
5. No smoking is allowed. A violation will incur an additional $500 fine and if additional cleaning is necessary to remove smoke odors, costs will be subtracted from the damage deposit.
6.Check-in time is 2 p.m. Mountain Time. Checkout time is no later than noon the day you are scheduled to leave.
7.When you arrive, the house will be clean and set up with linens. Dishwasher soap, hand soap, toilet paper, tissues, and laundry soap are provided.
8.The house is heated with radiant heat. Thermostats are pre-set throughout the house. Please note that thermostat adjustment takes 3-4 hours to reach desire temperature.
9.Guest is expected to monitor and be responsible for the use of the outdoor spa. Children are not permitted in the spa unless there is constant adult supervision.
Guest assumes responsibility for any use of the hot tub during his/her stay. Please make sure to return the cover to its position immediately after you finish using the spa.
10.Please follow the instructions on using the two fireplaces. The fireplace blower switches (the right hand switch on each switch plate) must remain in the ON position at all times.
11.Telephone service is available at no charge for all calls within the US. Avoid using directory assistance; charges will be deducted from your damage deposit. Wireless Internet access is provided at no cost (provide your own wireless device).
12. Set out trash bin on opposite side of road prior to 7 a.m. Thursday.
13.Games are supplied for our Guest’ enjoyment. Do not allow toddlers or infants to play with small game pieces or parts.
14.Proprietors are not liable or responsible for personal items left behind, lost, or stolen. If you leave an item after checking out and wish to have it returned, call us as soon as possible and we will arrange for shipment. We will inform you of the shipping cost and deduct it from your damage deposit.
15.We understand that accidents happen (that dishes and glasses get broken). So that we can provide the highest level of service to our next Guest, we request that you leave a note on the kitchen counter detailing the accidental breakage on departure or notify us by E-mail within 24 hours of your departure. Deductions from the damage deposit for any breakage (accidental or otherwise) are at Proprietor’s discretion. If the cost of the damage exceeds the amount of the damage deposit, Guest agrees to pay the difference.
15.Proprietors will cover the cost daily light housekeeping and an 8-hour cleanup after guests leave (the average time required). This assumes the kitchen area will be left in reasonable condition—dishes in dishwasher (and dishwasher running); no pans or additional dishes or glassware that need to be washed.
