TERMS AND CONDITIONS
1.The Tenant hereby agrees to the occupation of the premises for use as short-term accommodation for the period as set out in the attached booking form and agrees to pay the rental for the full period (prior to occupation), free of any deduction or set-off.
2.Cancellations more than 30 days prior to arrival will be subject to a 50% cancellation fee. Cancellations less than 30 days prior to arrival will be subject to a 100% cancellation fee. Cape Coastal Accommodation reserves the right to retain the full amount of the rental cost. The Tenant is responsible for travel and cancellation insurance and Cape Coastal Accommodation advises Tenants to also take out contents insurance.
3.The Tenant who makes the booking hereby warrants his/her authority of behalf of all persons included in the booking to agree that all such persons shall be bound by the terms and conditions of this rental agreement.
4.An inventory should be supplied at the date of occupation. The Tenant will have 24 hours to check, sign and return the inventory schedule noting any defective or missing items, failing which the inventory shall be deemed to have been handed over in good order and condition. The Tenant undertakes to keep the contents and equipment in the same condition as at the commencement of occupation and confirms that that the cost of any missing / broken / damaged items will be deducted from the security and breakages deposit.
5.The cost of telephone services if any provided during the period of occupancy is for the Tenant’s account. Should the Tenant not settle the final accounts for telephone services supplied during the period of occupation prior to departure, the total amounts due will be deducted from the security and breakage deposit.
6.It is recorded that the entire Premises, including any carpets and upholstery, will be clean and in good order on the date of occupation. The Tenant undertakes, on termination, to deliver the Premises in the same good order. Should Cape Coastal Accommodation, the Landlord or his Property Manger upon inspection, find that the Premises is not clean and in the same good order as at the date of occupation, (fair wear and tear accepted) they will engage the services of professional cleaners and/or carpet cleaners, at the cost of the Tenant and deduct such cost from the refundable security and breakages deposit. The Tenant undertakes to keep the property in a clean, tidy and sanitary condition.
7.Should the Tenant find anything that seems to be faulty with the premises, Cape Coastal Accommodation will have within reason, 24 hours from receipt of the Client’s notification of this problem to fix the faults.
8.The accommodation is booked by the Client as per the description, images and details presented to the Client. Cape Coastal Accommodation cannot be held as the responsible party should the Client be unhappy with the Client’s choice of premises.
9.A damage deposit of R 1 500.00 will be payable via EFT into Cape Coastal Accommodation’s bank account prior to arrival. Should there be no breakages or damages, this deposit will be released no later than 10 working days after the date of departure. Should any damages or breakages be found, the monetary value will be deducted from the damage deposit. If the total amount of the damages exceeds the damage deposit the balance of the amount shall be deducted from your credit card. Failing this the cost of damages exceeding the deposit held and no credit card details supplied, the matter shall then be between the Lessee (the Tenant) and the Lessor ( the Owner). Should you find anything on arrival that is broken, damaged or not in a good working condition, you are to report it on the same day to avoid any discrepancies and this being claimed against your breakage deposit. If the Tenant has not notified Cape Coastal Accommodation within 24 hours of the arrival date of any defects in the premises, the Tenant shall be deemed to have acknowledged that the premises were received in a good order and condition.
10.The premises are let for the sole use as a private residence only and any commercial activity must be expressly authorized prior to occupation. If any unauthorized commercial activity occurs, the rental rate for the period will be doubled (2 times) the agreed rate. The number of guests is not to exceed the number set out on the attached confirmation, if more guests than were paid for on the booking are found in the property, all guests will be asked to leave the premises immediately with no refund. The Tenant shall not sublet or part with possessions of the premises or part thereof.
11.Under no circumstances are any parties allowed at the property without prior written permission.
12.Please note that there is no smoking permitted in the property.
13.Please note there are pets allowed on the premises by prior written arrangement.
14.Please ensure that all doors and windows are closed and locked when departing from the premises at all times.
15.The Tenant indemnifies Cape Coastal Accommodation and the Owner from any constructional work being carried out in the vicinity of the property.
16.The Tenant shall not have any claim of any nature against Cape Coastal Accommodation or the Owner in respect of any theft, loss, damage or injury to the guests whether due to any negligence on the part of Cape Coastal Accommodation, the Owner, their agents, their staff or otherwise, by reason of any latent patent defects in the premises or fire in the premises of theft from the premises, or by reason of the premises or any part thereof being in a defective condition or state of disrepair or any particular repair not being effected by Cape Coastal Accommodation or the Owner timeously or at all or arising out of any defect in the water, gas or electricity supply to the Premises or arising out of vis major or any other cause wholly or partly beyond Cape Coastal Accommodation’s control or the control of the Owner or arising from any other cause whatsoever.
17.The Tenant undertakes to maintain reasonable noise levels at the property at all times as excessive noise may be in contravention of the laws of the Republic of South Africa, body corporate rules and/or the municipal by-laws. In the event of the Tenant transgressing the body corporate rules and/or the municipal by-laws, he/she accepts that this may lead to the short term lease being terminated immediately by the Owner, his Property Manager or Cape Coastal Accommodation, and in which case all monies paid will be forfeited.
18.The cost of replacement of all keys, tags and remotes not returned to Cape Coastal Accommodation, the Owner or his Property Manager will be deducted from the refundable security and breakages deposit. This could include the replacement of all security keys to re-secure a complex. The Tenant is not permitted to make any duplicates of any keys or remotes in respect of the premises.
19.The Tenant hereby chooses domicilium citandi et executandi for all purposes at the premises. The Tenant accepts that this Agreement shall be governed and construed in accordance with the laws of the Republic of South Africa, and in case of dispute, the Tenant irrevocably agrees to submit to the jurisdiction of the High Court of South Africa or the Magistrates Court of South Africa, at the election of Cape Coastal Accommodation. In the event of Cape Coastal Accommodation, the Owner and/or his Property Management taking any action against me, I agree to pay costs on the attorney and own Client scale.
20.Please be advised that the Owner receives 50% of the rental payment once the booking is confirmed. In the event of the premises not being available, Cape Coastal Accommodation shall endeavour to find suitable alternative accommodation but will not in any circumstances be held responsible for any losses suffered by the Tenant as a result thereof. In the event of cancellation by the Owner all monies held by Cape Coastal Accommodation on behalf of the Tenant will be refunded. Cape Coastal Accommodation receives full commission up front on confirmation of the booking and cannot be held liable to refund this money if the property is not available, is cancelled by the Owner or a refund is sought due to negligence on the premises on the part of the Owner in any way.
21.In the event of the Tenant vacating the premises prior to the contracted departure date for any reason whatsoever, he/she shall have no claim for the refund of any rental monies from Cape Coastal Accommodation and/or the Owner.
22.In the event of the Tenant breaching any term of this agreement, the Owner shall be entitled to terminate this agreement forthwith and the Tenant undertakes to immediately vacate the premises. Any breach by the Tenant shall constitute a material breach for the purposes of any proceedings taken against the Tenant.
23.The Tenant agrees that Cape Coastal Accommodation and/or the Landlord and/or their Property Manager or representatives shall be entitled to inspect the premises upon reasonable notice at all times during the rental period.
