This is Serenity at Buttonwood Reserve, the Eleuthera condominium featured on HGTVs Beachfront Bargain Hunt! This extraordinary new condominium is located on a ridge 45 feet above the Caribbean. The views of the ocean are truly breathtaking.

The space

From your condominium’s large windows and extensive decks, you have a 50-mile, 180-degree view of the Caribbean, facing west to watch the sunset over the ocean.

Buttonwood Reserve has access to two beaches, a small beach on the Caribbean side with calm shallow water, almost in your front yard, and a world-class, 3-mile-long pink-sand beach on the Atlantic side of the property. The Atlantic side beach is accessed via a private driveway. The condominium comes with a golf cart for easy access to the Atlantic beach. If you’re not in the mood for a swim in the ocean, slip into our new resort-style pool, just steps from your condominium. This beautiful landscaped pool is heated for comfortable swimming year round.

This Short Term Rental Agreement (the “Agreement”) is made by and between
Rick Gugliucci (“Homeowner”) and the Renter identified in Section 1 below (“Renter”) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1.Property: The property is located at:

Buttonwood Reserve Condominium Unit 1B, “Serenity” – Governors Harbour, Eleuthera, Bahamas (This is the lower level condominium on the north side of the building)

The property is fully furnished and includes a complete supply of bed linens and towels. Beach towels are provided. Bath towels are not to be taken to the beach or pool. Patio furniture is not to be taken to the beach. The Renter has access to all the rooms in the house with the exception of the locked closets and pantries. You as the Renter, agree to take all reasonable steps to ensure that your family and other guests in your party follow the rules and regulations outlined in this document.

2.Rental Party: The rental party shall consist of the number of Persons set forth in Section 7 below.

3.Capacity of House – The total number of persons allowed in the houses at any one time is restricted to the number of persons scheduled and paid for in the reservation. Presence of additional guests will subject Renter to immediate eviction and forfeiture rent. Parties and events are not permitted without the written permission of Homeowner.

4.Term of the Lease: The lease begins at 4 p.m. on the “Check-in Date” indicated in Section 7 and ends at 10 a.m. on the “Checkout Date” indicated in the Key Terms paragraph above.

5.Rental Rules: Renter agrees to abide by this Short Term Rental Agreement at all times while at the property and shall cause all members of the rental party and anyone else Renter permits on the property to abide by the following rules at all times while at the property.

6.Complaints and Maintenance: The Homeowner will make every effort to keep the premises and inventories in good working order. The Homeowner will provide the Renter in advance with the name and contact information of such persons in charge of any maintenance problem. In the event, there is a maintenance problem; they will strive to repair the problem as soon as possible after being notified. No refund or rate adjustment will be made for unforeseen mechanical failures such as the supply of electricity, water, pool heater/filtration systems, air conditioning, telephone, television/cable service, appliances, etc. It is the Renter’s responsibility to report any problems or damage immediately to the local property manager.

7.Payment and Cancellations: – Cancellation of or changes to your reservation must be made in writing (e-mail or fax is acceptable). If you cancel more than 90 days before your scheduled arrival, 20% of the total rental amount will retained by Homeowner and the balance refunded to you. If you cancel within 90 days of your arrival, 50% of your total rental fee will be retained by Homeowner and the balance refunded to you. If your cancellation occurs within 45 days of your arrival 100% of your rental fee will be retained by Homeowner. No-shows, late arrivals, decrease in number of persons, or early departure for any reason, including but not limited to inclement weather or illness, are non-refundable. Homeowner recommends trip insurance to protect Renter against loss from such events. This contract becomes binding when the rent is paid. Failure to make any rental payment when due will subject your reservation to cancellation.

8.Use of Golf Carts: The golf carts are available for use only by the renter and members of renter’s family who are age of 16 years or older. The golf carts are for use ONLY on the property of Buttonwood Reserve for travel between the condominium and the Atlantic beach. Use of golf carts on public streets and roads is UNLAWFUL will subject the user to civil and criminal fines and penalties. Use of golf carts on public streets and roads is STRICTLY PROHIBITED by this rental agreement. Any use of golf carts in violation of this agreement, including use by children under the age of 16, will result in a $200 penalty and immediate eviction of renter and forfeiture of all rents and deposits made hereunder. Homeowner will deduct any damage to golf carts and any fines or penalties resulting from their misuse from renter’s damage security deposit. By using golf carts renter assumes any and all risk associated with the operation of golf carts and any liability for damages to the third parties incurred through the operation of golf carts.

9.Electricity Usage. Owner will pay for electricity charges up to $100/week, prorated. Renter will be responsible for electricity charges in excess of $100/week. Owner will read meter upon guest’s arrival and guest’s departure.

10.Damage Security Deposit: - Damage deposits are fully refundable within 21 days of your departure. Pending there is no breakage, damage, missing items, long distance calls charged to the house phone, excess electricity usage ,or additional clean-up necessary due to your leaving the property excessively dirty. You hereby agree to pay the Homeowners the cleaning or replacement costs for any and all damages to the entire property which may occur as a result of you or your guest’s occupancy, excluding normal wear and tear. A flat rate cleaning charge of $250 will be applied for any smoke odor inside the apartments.

11.Drugs and Hazardous Materials – The renter and members of his/her group are prohibited to use or bring onto the property any illegal substances, flammable fluids, explosives or items deemed hazardous to life, limb or property.

(website hidden) Pets – No pets of any kind are allowed in or around the premises without written consent of the Homeowner being granted before arrival. A pet or evidence of a pet found on the premises will cause immediate eviction, and forfeiture of Guest’s entire rent and deposit.

(website hidden) Smoking – Smoking is prohibited in all interior areas of the house. Please ensure that all smoking materials are extinguished and disposed of in proper manner when smoking outdoors. Any evidence of smoking inside of the house will cause immediate eviction, and forfeiture of Guest’s entire rent and deposit.

14.Insurance: Homeowner is in no way responsible for any personal injury or bodily harm that may occur on the property to any Renter or their guests, nor for any damage or loss of Renter’s personal belongings.

15.Transfer of Ownership of the Condominium: Owner and Renter will be bound by this agreement even in the event that ownership of the house is transferred by sale, bequest, or other means. Owner and Renter agree that this agreement shall survive any such transfer and Owner agrees that Renter shall be a beneficiary to the extent of Owner’s obligations under this agreement of any arrangement to so transfer ownership.
